Terms of Use

Please read these Terms of Use carefully before accessing or using the AyurXpert Technologies platform. By registering an organisation or logging in as a staff member, you agree to be bound by these terms.
1. Definitions
- "Platform" — the AyurXpert Technologies web application and related services available at ayurxpert.in and associated subdomains
- "Organisation" — a hospital, clinic, pharmacy, wellness centre, or other healthcare entity that registers on the Platform
- "Admin" — the representative of an Organisation who registers and manages the Organisation's account
- "Staff" — doctors, nurses, receptionists, pharmacists, lab technicians, and other professionals added to an Organisation's account
- "Patient" — individuals whose health records are created and managed within the Platform by an Organisation
- "We / Us / AyurXpert Technologies" — the entity operating the AyurXpert Technologies platform
2. Eligibility and Registration
- The Platform is intended for use by registered healthcare organisations and their authorised staff in India
- By registering an Organisation, you confirm that the Organisation is a legitimate healthcare entity operating in accordance with applicable Indian law
- You must provide accurate and complete information during registration. Providing false information may result in immediate termination of your account
- Each Organisation is responsible for maintaining the accuracy of its registration details
- The Admin who registers an Organisation accepts these Terms on behalf of the Organisation and all its Staff
3. Permitted Use
The Platform may be used solely for the following purposes:
- Managing patient registrations, appointments, and health records within your Organisation
- Generating prescriptions, lab reports, and clinical documentation
- Managing pharmacy inventory and billing for healthcare services
- Enabling ABDM-compliant health information exchange with patient consent
- Internal administrative and operational management of your healthcare Organisation
4. Prohibited Use
Violations of these prohibitions may result in immediate suspension and legal action.
You must not:
- Use the Platform for any purpose other than legitimate healthcare operations
- Access, modify, or attempt to extract data belonging to another Organisation
- Share login credentials with unauthorised individuals
- Upload false, fabricated, or misleading patient records
- Use the Platform to store or transmit data in violation of Indian healthcare regulations
- Attempt to reverse-engineer, copy, or exploit any part of the Platform's code or infrastructure
- Use the Platform in any way that could harm patients or violate their rights
- Share patient data outside the Platform without appropriate legal basis and patient consent
5. Patient Data Responsibility
As the Organisation using this Platform:
- You are the Data Fiduciary for patient data in your custody, as defined under the Digital Personal Data Protection Act 2023
- You are responsible for obtaining appropriate patient consent before recording their health information
- You are responsible for the accuracy of records entered by your staff
- You must ensure your staff use the Platform only for authorised purposes
- You must promptly report any data breach or suspected unauthorised access to privacy@ayurxpert.in
- AyurXpert Technologies acts as a Data Processor on your behalf and processes patient data only as directed by your Organisation's use of the Platform
6. ABDM Compliance Obligations
If your Organisation participates in the Ayushman Bharat Digital Mission (ABDM):
- You must comply with all ABDM policies, including the Health Data Management Policy (HDMP)
- You must obtain explicit patient consent before linking records to ABHA IDs or sharing through the ABDM network
- You are responsible for ensuring your staff understand and follow ABDM consent procedures
- Any misuse of ABDM functionality may result in de-registration from ABDM as a Health Information Provider (HIP)
7. Staff Accounts and Access Control
- Each staff member must have their own individual login — account sharing is prohibited
- The Admin is responsible for approving, managing, and revoking staff access
- When a staff member leaves the Organisation, the Admin must promptly deactivate their account
- Staff are granted access only to the features and records relevant to their role
- You must notify us immediately if you suspect any unauthorised access to your Organisation's account
8. Platform Availability
- We aim to maintain high availability of the Platform but do not guarantee uninterrupted access
- Scheduled maintenance will be communicated in advance where possible
- We are not liable for losses arising from temporary unavailability of the Platform
- You should maintain your own backup procedures for critical patient records
9. Intellectual Property
- All software, design, trademarks, and content on the Platform are owned by AyurXpert Technologies or its licensors
- You are granted a limited, non-exclusive, non-transferable licence to use the Platform for your Organisation's healthcare operations
- You may not copy, reproduce, or distribute any part of the Platform without our written permission
- Patient data and records entered by your Organisation remain the property of your Organisation and your patients
10. Data Export and Termination
- You may request an export of your Organisation's data at any time by contacting support@ayurxpert.in
- Upon termination of your account, you will be provided a final data export within 30 days
- After the export period, your data will be securely deleted from our systems within 90 days
- We reserve the right to terminate accounts that violate these Terms, with prior notice where possible
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- AyurXpert Technologies provides the Platform as a digital tool to support healthcare operations — it does not provide medical advice
- Clinical decisions remain the sole responsibility of the qualified healthcare professionals using the Platform
- AyurXpert Technologies is not liable for any clinical outcomes, medical errors, or patient harm resulting from the use of the Platform
- Our total liability to any Organisation shall not exceed the fees paid by that Organisation in the three months preceding the claim
12. Governing Law and Disputes
- These Terms are governed by the laws of India
- Any disputes arising from these Terms shall be subject to the jurisdiction of the courts in India
- We encourage resolving disputes amicably through our grievance process before legal action
- Grievances may be submitted to support@ayurxpert.in — we will respond within 30 days
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Platform, applicable law, or regulatory requirements. We will notify registered Organisations of material changes via email with at least 14 days' notice. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
